1. Required Deposit. All contracts require a 25% deposit of the respective total project cost prior to beginning an assignment. A California sales tax rate applies for tangible-project deposits received from clients residing in the state of California. This amount, with a digital or written contract signature, serves to activate the client’s contract and reserve specific dates (if applicable). This policy is effective as of January 1, 2012.

2. Contract Cancellation Fee. A cancellation fee of 25% of the total project cost applies for clients who discontinue their contractual relationship with the company after their contract has been activated (when the requested deposit has been received and successfully processed). This percentage is subject to local sales tax. All original work, materials, ideas, concepts, digital files, and content belonging to the contractor must be returned to the contractor. This information will be held as the intellectual property of the company.

3. Working Deadlines. All contracts include estimated working deadlines that are subject to change. If additional time is required to complete the client’s project, the decision to extend the working deadline is to be agreed upon in written correspondence between the contractor and client, in reasonable time. We are a company that honor our deadlines  however, sometimes flexibility is necessary, and we may have some delays with some of the projects.

4. Communications Policy. SF Website Design will provide timely communications, via email or phone, for all services rendered. The timeliness for completing a project is also influenced by the client’s availability and communication. During our professional relationship, it is expected that both parties are available to work together effectively and discuss plans as needed.

We don’t usually charge for phone consultation. We will let you know if we will charge you, if you will need extended information. This policy does not apply to flat rate package solutions (such as websites design).

5. Additional Project Resources. Any and all additional resource expenses, such as typefaces, stock photography, plugins or other items not included within the original services contracted, are to be invoiced to the client upon the completion of the project, containing all outstanding payment due.

6. Flat Rate Project Extensions. Projects that exceed a time ceiling may be continued at an hourly extension rate. Time ceilings are set as a general estimate to my clients for budgeting purposes. However, based upon the unique needs of each client, additional work time may be required. Extension charges are to be added to the final payment due upon completion of an assignment.

7. Rework Fees. Graphic Design materials created by my studio that require reworking modifications after finalization will encounter a rework fee equivalent to the original hourly rate of work incurred. If the cause for rework is at the fault of my studio (due to technical, grammatical or spelling errors), the relevant rework will be provided at no charge.

8. Final Payments and Late Fees. Final payments are to be generated within ten (5) days of an invoice date. A non-negotiable late fee of $75.00 applies to final payments received twenty-one (21) or more days past the invoice date. Payments taking longer than thirty (30) days to process will result in a potential suspension of my creative services. Out of fairness, I expect timely compensation for my efforts as an active professional. Timeliness is much appreciated.

9. California Sales Tax. Only tangible services provided by SF Website Design to clients within the state of California are subject to local sales tax rates, as determined by the California Board of Equalization. Out-of-state clients are not subject to California sales taxes for professional services and goods purchased from SF Website Design.

10. Payment Methods and Terms. Payment is accepted in the forms of cash, credit card and check. All credit card transactions are securely processed with PayPal, and incur a 3.0% convenience fee to be added to payment due.

All payment is final, and refunds will not be provided. Prices and services are subject to change without notice. For information on my return policy, please see below.

11. Return policy. All sales with SF Website Design are final. No returns will be offered or accepted on graphic design, or website design/development services unless they meet the following exceptions:

If damage to services or goods rendered occurs, including possible unintentional deletion of relevant electronic files or damage/harm occurring to professional prints upon being processed and/or delivered, Scott Werley Creative will provide the same product or service at no cost to the client. The cost of these replaced services and/or goods shall be equivalent to the value of their original counterparts.
